" Rule, Law and Understanding "
How any system or procedure will run is called rule. And if that rule can’t be changed forever, we call it law. It means there is chance to make changes in rules but not in laws. So each law is rule but rule is not law. In normal transactions, we form rules for good management. And we change those rules as per the change in situation. And there is understanding but no compulsion in rules. If it becomes obligation it becomes law.
We all play one or another game. Let’s consider the cricket. Cricket has particular rules of playing cricket. Like, 1 over will have 6 balls, 11 players, pitch size, style of ball, total overs and many more. And we all know that kids play cricket in streets also. According to that street situation and total players, they form their own rules of the game. Beyond the boundary of particular house there will be 4 runs. If it touches to particular wall, there will be fixed 2 runs; 1 bounce catch is valid, if it touches to any window it will be considered out; if ball goes on any terrace it will be considered out, likewise. Think about all games you know and you will find such rules. And game rules are changed as per need.
Each house has own rules as per the stuff or facility available inside the house. Like drinking water should be taken by particular vessel. Vehicles should be parked at particular location. Keeping electricity switches off when no need. Who will use which bedroom and why? This cupboard is for his clothes and that cupboard for her clothes. Dirty clothes should be put here and washed clothes there. Shoes and sandals should be kept at particular location. Same way one organization has own rules.
Consider a school, school will start at 10.30; last upto 5pm; there will be 3 breaks of exact timings; one period will be of particular time span; one class will have maximum of x number of students. Everywhere you see such rules. There is nothing without rule. But It should be well considered where there should be rules and where the laws. Human can make rules and not laws. Only nature got that authority to make laws but foolish human makes rules and call it laws. In reality human needs own rules only as per situation and deep understanding or clarity of those rules. There is need to follow those rules by clear understanding, and not laws. In the field of natural laws human should understand all the laws of nature and obey them and respect them. After that form the rules which are coordinating these natural laws and run those rules with understanding to run this life better. We never were law makers and we can never be. We can always make normal rules and only that we have in our hands. Good human life can be created only by obeying natural laws and making rules according to particular location, situation and requirements. Natural laws are working for any location or for any organization. So by ignoring natural laws if we make our own rules then believe me we are creating troubles for us.

According to any particular location and situation if we make rules and if one community lives according to those rules for many years, we call it tradition or fashion or culture. If someone comes to our house, very first, we greet him with good words then we invite him inside the house and give him glass of drinking water. Then after few talk to him we ask for cold or hot drink. If that person is close one, we offer snacks. We call it tradition or you may say that it is our culture. If you try to understand all these rules, there is an effort or understanding to make human life better. These are rules and not laws. Sometimes it happens that when someone is in hurry, we may miss to give him drinking water or we may forget to invite him inside the house and we talk standing outside; just talk and gone and that is not considered wrong. This is rule and not law. Rule functions on understanding. It works on internal understanding.
Nature works on particular rules and all of those rules are fixed, so they are unchangeable. Means they are all laws and we identify them as Natural Laws. We are all governed by those laws and we are obliged to follow those laws. There is no escape. Water is base of life on the earth. So, everybody needs to drink the water. This is law. How many days can you survive without water? We intake only organic substances as a food. Inorganic substances can’t be used as a food. That’s why we are dependent on the vegetation which takes raw inorganic substances / minerals from the earth, combines it with the carbon of the air and sun energy and forms organic substances which we use as food. Non veg eater of the world eat same thing on second stage ( animals eat vegetation and they eat animals ). Eating coal or any minerals of the earth directly doesn’t serve our purpose much. In the body this same organic substances give us energy. To use this energy we need to burn it and required oxygen for that. So we have to take oxygen compulsorily. Our life is not possible without oxygen. This is law, break the law and loose the life. Someone who takes the birth will die one day. This is law. Rule is based on understanding but law is fixed or compulsory. Rules anybody can make and change but not laws. By forming new rules we can do things differently but laws can’t be changed. And if you ever try to go against the laws you have to bear heavy penalty for that.
Everything of nature is fixed; Sound waves, speed of the light, gravitation and such billions of things. Nature has so many laws and each law has its own space to work. That is a science. Science is nothing but the knowledge of those laws. Use of such one or many natural laws together to create useful thing is called technology. There is one law of nature and it is gravitation. As a result of gravitational law / force, earth always pulls things towards it. Eventhough gravitation exists, by using other natural laws ( science ), we developed technique to fly in the air. But it doesn’t make any sense that we killed gravitation. When we fail to use other natural laws then our aeroplane falls on the earth directly from the air. It shows that gravitation was present. Nobody is immortal means each one has to die one day. Few people in the world are called that they never died including ashwatthama, but that thing is never verified, nobody saw him or he is identified alive living for so many years. And let’s consider that they are immortal then they are 0.0000000001% of total population. So we can ignore them. Also they all were born. Whom you call gods ( in reality Great Humans ) all of them were born and died. So it is clear that these laws are firm.
We live in the zone of natural laws. We can never change this truth. So it is better thing that we accept them as soon as possible. As preciously humans understand this natural laws, accept and make this human life accordingly, is in favor of humans. Our life is within natural laws. There must be rules, they are most necessary things but not laws. Rules are voluntary, human made laws are compulsory and based on penalty. And once we lose our understanding what’s the meaning of laws? Without understanding, can these human made laws make human life better? Never ever. Foolishness starts as soon as human stars making laws and we can see that foolishness everywhere, now. Human will create the loopholes in all laws. By making human made laws did we solve the problems of humanity? Any problem came under control? We did not control problems but contrarily our life has been much complicated. You are informed by saying that these human laws are made for better management, but is it? Most of the time, laws are used to keep people under control by few people, by keeping the power in their hands. They make or destroy the laws as per their wish. That way they enslave the people. When somebody in power says that from tomorrow things will work like this and if somebody doesn’t obey it or work opposite to it will be considered as a criminal. From tomorrow, 500 and 1000 notes are valueless or from tomorrow you must have to wear helmet. These 2 examples are enough to understand all laws and their implication and effects on general people. You can find 100s of such examples. Conclusion is, human made law is like lose of understanding, foolishness and starting of slavery.
Because the nature created all of us unique, there must be some different opinions and those may create conflicts among peoples and those take the form of quarrel. Someone who is part of the quarrel whose mind would be caught with ego, revenge and bias; so, he can’t think freely and properly. Or due to the ego, quarrel can never end. To form one healthy society, such things should get quick and easy solutions. First thing is we should minimize or possibly completely eradicate the causes of quarrels or may be when the quarrel starts, we should start taking the steps to stop and completely solve it.
For the fast solution of the quarrel, we need 3 types of people. First types of people those who know very well the people involved in the quarrel, second types of people are eye witnesses of the quarrel or those who know the quarrel very well, third types of few people should be very intelligent, thoughtful, experienced, and having good decision power, also know the society’s overall mentality very well. By the cooperation of all these people we can have right and faster solution of the conflict.
I have not so deep information but what I have based on it I try to write something here. In previous old time, may be before 50 years in Indian villages there was a local body of people which was called Gram Panchayat. Their work was mostly to make major decisions related particular village or local area and solve such conflicts easily about that particular village. Or this was working for particular tribe or community where village people and wise elders sat together face to face and put things into discussion and tried to get the decisions of any matter. Whatever they decided was accepted with full respect by whole village or by community. In case of conflicts if someone is ready to accept his mistake, he was never punished hard but with easy punishment or mostly given the chance to improve himself that was one of the biggest positive side of it. Mostly disconnecting him socially, cutting of transactions partially or fully according to the mistake with that person was punishment for that person. No any other cruel steps were taken. Good thing was that there was not one but 5 or more people were main decision maker. All those people were well recognized as having good decision power and neutral in his approach for years. Those people knew all the people closely from years so in case of conflicts they knew well what one person can do or not. And so based on it they could decide effectively how to deal with that person and what can be the right approach. That system was not ideal but was much better. In those times, not whole community was aware of the rules and regulations made by wise people yet, this system worked nicely.

The constitution what we have now is made after the British Rulling and mostly copied from here and there, and law system is also based on it which is improper or mostly laughable. Most of the things I discussed above is not present in that. Someone who takes decision is a judge, he is only one to decide. This judge never knows both the accuser and accused any way. Also the people presented as witness can be wrong or forcefully made witness and that happens most of the time in present system. Judge never knows it. Most of the time the punishment is imprisonment and almost no chance is given to improve. The judge is a person has just passed the written tests so there is no surety how good he has connection to society or awareness of actual social structure and psychology of the people. Also we are not sure if he has ability to see the difference between right and wrong and in between accused and innocent people. Also that is always a question how good decision power he has.
Foolishness of the judge and without good lawyer, by law, someone innocent can be proved criminal; that is weak side of this system. As this is a world of money, if you can bribe clerk, government lawyer, and main decision maker judge, you can easily get the result in your favor. So, here in this system, in the conflict, it is not possible to verify who is at fault. Also to get the result it takes very long time, 2 years to 10+ years. It means this law system is not right. In this system many times an innocent person presented here as accused takes long time to be proven innocent and in many cases he spends time in the prison for that period under trail. Many real criminals either gets proven innocent without having enough evidences or get bail/ parole and we find them moving freely in the society. In the court, not a single answer is given by accused but by his lawyer. So that is one more weak side of this system.
We can see that in present world, few people are having more assets than they need and others are struggling to get even their basic needs. What will this scarcity facing person do? He will try to take or snatch from the house of that rich man. And in legal terms we call it theft or robbery and that particular person as criminal. We will try to punish that person for that by legally or illegally. Do you think this is right? Yes, you will feel this is right. Let’s try to understand what’s wrong here. Our social system is such that we are unable to fulfill the basic needs of someone. In that time, one person to save himself, is forced to steal things. Community or society is at fault and not that individual.

Even today, we see that few families having 1000+ acre lands. In human made laws it is considered that they have got it as heirs. And there are so many families where there are around 10 family members, having not much assets as heirs and from generations they are engaged with farming and may be having very less land like 2 acres aground, how can this be possible? You may understand now that once you form the law, foolishness started. Human made laws are used mostly to strengthen the injustice than to provide justice to people. In the society, 90% thieves out of total 100% are stealing the stuff to fulfill their basic needs. Rest of 10% thieves has 2 categories, one is got theft in heredity or tradition and others are mentally ill and they are white thieves ( Politicians, Mafias and similar kinds of people ). So it means this 10% thieves are stealing for other purposes than fulfilling their basic needs. As a society very first we need to make arrangements for 90% needy thieves and other similar people those who are needy but never steal. They all should get their basic needs met easily. After that we need to correct mental illness of those 10% white thieves and other habitual thieves by planting seeds of understanding in them.
Legalization: Make it legal by law. In this present world, to prove something is mine people use this method of legalization. In that procedure, by following human made laws, by writing matter on special paper with signature and stamp on it, it becomes possible.
In the present world and in the society only those marriages are valid which are done legally. If there is legal record of marriage, those 2 people will be called married to each other. It is same for property. If there is legal written papers with signatures mentioning you are owner, then you own that property. The biggest mistake of this system is if you wish it or not, but what is written on the paper is truth or valid. If 2 people are not connected to each other by heart but still if there is legal record of marriage then they are called married or life partners. On paper relationship is most valuable and valid more than understanding and connection of heart. To tie 2 people ( by their wish or without wish ) this method is used and we have accepted it firmly. After marrying someone for 2 years if you clearly understand that you are unable to adjust with your married life partner, no more feel love, not happy to live with that person anymore then to break it ( take divorce ) from the legally made agreements on the paper ( legal marriage ), you get 6 months to 2 or 3 years time. From the childhood we are not taught to make relation of hearts and when we are young, we are forced to tie someone, or to maintain the relation by legal documents, which never succeed.
Humans have made thousands of laws and as many loopholes in those laws. And just to study the laws made by human, human himself takes years and then become an expert. And even after knowing that many laws, they still never know all the laws. Each human should be well informed by laws. But here when the main expert people don’t know all the laws then what can we say about other people? Is this intelligent management of human society? And also by many laws and those loopholes in the law system, we have made whole management system so much complicated and still making it even more complicated. To prevent loophole of first law, we create second law, now we create third law to prevent loophole of second law. And that way, we have created very big chain or raw of laws. So it is like, to improve one mistake we do second mistake and to improve second mistake we do third mistake. So, chain of mistakes. What is our aim; to make life easy or complicated? By creating human made laws, did we create better human life? Does the theft stopped? No, more we created laws, more we got crimes. By show off of making life easy, we made it most complicated. Is that the aim of our life?
Within the life under natural laws, to make better human life we need more collective understanding and not those human made laws. Good human life is possible by understanding and not by human made laws.

What are your suggestions to improve existing law and legal systems?
"You are asking me what improvements, what changes, are needed in the legal system. As I see it, it is basically wrong. It needs nothing less than a revolution; because down the centuries you have been increasing your courts, judges, legal experts, and laws have become everyday more and more complicated. And the criminals are growing tremendously. By all this legal system on one hand increasing, on the other hand the crime goes on increasing, ten times more than your legal system. You have not been able to cope with it. There is something very fundamentally wrong.
"As I see it, first the whole legal system is based on social revenge, not on social compassion.
"Your whole legal system is a revenge system. The society punishes a person because he was disobedient, because he did not follow the crowd, because he was not part of the mob. He tried to be an individual on his own. He was playing his game according to his own rules. Revenge is not going to help, because you are doing the same crime that the criminal has committed. Of course, you have the support of the whole society; so nobody calls your punishment a crime. But any unprejudiced mind can see what you are doing.
"A man commits rape. A man commits robbery. A man commits murder. Certainly something has to be done. But not punishment. Because the man who commits rape simply means he is sexually unsatisfied. And your society has not given him a chance to be sexually satisfied. - Osho, The Last Testament.
- In addition I would like to add a paraphrase of B.F.SKinner : The concept of "freewill" and "freedom of choice" allows society to blame individuals for the failings of society and therefore people can be "justly punished". No law can recognise that if people are hungry - they will steal therefore the problem lies with the inability of society to feed people, not on peoples "choice" to steal, because it is no choice if you are starving."
